    The Legal Journey of a Property Purchase

    Buying property involves a series of legal steps, each with specific obligations and protections. Many buyers — particularly those purchasing in a market other than their home country — find the process opaque. At Norge Eiendom, we believe informed buyers make better decisions and have smoother transactions. Here is a clear walkthrough of the legal process.

    Stage 1 — Offer and Acceptance

    A verbal or informal written offer, once accepted by the seller, creates a moral but not legally binding commitment in most jurisdictions. The purchase becomes binding only at the preliminary contract stage.

    Before making any formal commitment, ensure you have:

    - Confirmed your financing (mortgage pre-approval or proof of funds)

    - Reviewed the property's cadastral details and plan

    - Identified your notary or legal representative

    Stage 2 — Preliminary Contract (Compromesso / Kjøpekontrakt)

    The preliminary contract commits both buyer and seller to the transaction. At this stage, the buyer typically pays a deposit of 10–30% of the purchase price.

    Key protections in the preliminary contract:

    - If the seller withdraws, they return double the deposit

    - If the buyer withdraws, they forfeit the deposit

    - The contract specifies the agreed price, completion date, and any conditions (e.g. subject to mortgage approval)

    Never sign a preliminary contract without having it reviewed by your notary or legal advisor. Verbal assurances do not override the written terms.

    Stage 3 — Due Diligence Period

    Between the preliminary contract and the final deed, your notary will verify:

    Title search: confirms the seller is the registered owner and has the right to sell.

    Encumbrance check: verifies no mortgages, liens, easements, or rights of way affect the property beyond those already disclosed.

    Planning compliance: confirms the property matches its approved plans and that any extensions or modifications have the necessary permits.

    Condominium compliance: for apartment buildings, verifies there are no unpaid charges that would transfer to the buyer, and reviews the building's reserve fund.

    Energy certificate: must be provided by the seller before the final deed is signed.

    Any issues discovered during due diligence should be addressed before proceeding. Common resolutions include price reductions, seller undertakings to regularise planning issues, or in serious cases, withdrawal from the transaction.

    Stage 4 — The Final Deed (Rogito / Skjøte)

    The final notarial deed is the moment of legal transfer. It is signed before a notary who:

    - Reads the deed in full to both parties

    - Confirms identities

    - Witnesses signatures

    - Registers the transfer with the land registry

    At this point, the balance of the purchase price is paid (typically by bank transfer), and the keys are handed over. Ownership transfers legally at the moment of signature.

    Notary fees, land registry taxes, and any applicable purchase taxes are paid at this stage. The notary will provide a clear breakdown in advance.

    Foreign Buyers: Additional Considerations

    If you are purchasing in a country other than your tax residence, be aware of:

    - Tax residency implications: some countries' tax treaties affect how property income and capital gains are taxed

    - Anti-money laundering requirements: proof of the source of funds is mandatory for all purchases above certain thresholds

    - Currency risk: if your income is in a different currency from the purchase, consider when to convert

    - Local tax representation: some jurisdictions require non-residents to appoint a local tax representative
